The mission of the Fondation Santé Baie-des-Chaleurs is to contribute to the financing of projects aimed at developing the health and social services offered in the Baie-des-Chaleurs region. These projects are guided by the noble goal of improving the health and well-being of the population, while encouraging community participation.  At the Fondation Santé Baie-des-Chaleurs, we are committed to protecting the confidentiality of the personal information of our donors, beneficiaries, partners, employees and volunteers, and to using it only within the framework of our operations (Quebec's Bill 25, Personal Information Protection and Electronic Documents Act). We adhere to the highest ethical standards when handling all information, especially personal information.

This Privacy Policy is intended to help you understand our practices regarding the collection, use, disclosure and retention of personal information. By providing us with personal information (through our website, by email, by completing an event registration form or by making a donation in person, online or by telephone), you agree to the processing of your personal information in accordance with this Privacy Policy, and you authorize the Fondation Santé Baie-des-Chaleurs, its third parties and its service providers to process your personal information for the purposes set out below.

 

This Privacy Policy does not apply to third party websites that may be accessed by clicking on links on this Website, and the Baie-des-Chaleurs Health Foundation is not responsible for such third party websites. What type of information does the Foundation collect?

  • When you make a donation to our organization, whatever the form of your donation;

  • When registering for events and newsletters;

  • When registering for our fundraising activities;

  • When you register as a volunteer for our organization;

  • During the provision of services to you.

 

We also collect publicly available information, including from public platforms, including your website.

How do we use personal information?

We may use personal information in any of the following ways, with your consent or, where applicable, on another legal basis. In each case, we indicate the purposes for which we use your personal information:

 

  • In order to provide our services and for the conduct of our business, to administer and perform our services, including to carry out our obligations arising from any agreement entered into between you and us.

  • To make our website easier to use and to ensure that content is relevant to you and to ensure that content from our website is presented in the most effective manner for you and for your device.

  • For marketing and business development purposes – to provide details of new achievements, information about developments in our organisation and industry and invitations to our events, where an individual has opted in to receive such information.

  • For research and development purposes (including from a security perspective) – to conduct analyses to better understand our donors’ service and marketing requirements and to better understand our organisation and develop our services and offerings.

  • For recruitment purposes – to enable us to process job applications and assess whether an individual meets the requirements of the position for which they may apply at the Baie-des-Chaleurs Health Foundation.

  • In order to meet our legal, regulatory or risk management obligations.

  • To prevent fraud and/or carry out other background checks that may be required from time to time by applicable law or regulation and/or best practices (if false or inaccurate information is provided or fraud is identified or suspected, information may be passed to fraud prevention agencies and may be recorded by us or by such agencies). Where we process special categories of personal information, we may also rely on important public interest considerations (prevention or detection of crime) or legal claims;

  • To enforce our rights, to meet our legal or regulatory disclosure obligations, or to protect the rights of third parties.

  • To ensure that we are paid – to recover payments owed to us and, where appropriate, to enforce such recoveries by using debt collection agencies or taking other legal action (including taking legal action).

  • In order to reorganize or change our organization – if we undertake a reorganization (for example, by merging, consolidating or transferring part of our organization’s mission), we may need to transfer some or all of your personal information to an applicable third party (or its advisors) as part of any due diligence process or transfer to that reorganized entity or third party for the same purposes as those set out in this Privacy Policy or for the purposes of analyzing any proposed reorganization. With whom do we share personal information?

The Baie-des-Chaleurs Health Foundation is a non-profit organization duly incorporated and recognized as a charity, therefore, the personal information we collect may be transmitted to any entity in the Baie-des-Chaleurs Health Foundation network and processed by such an entity. We may also share personal information with certain third parties, including the following:

 

  • Volunteers and clients of the Baie-des-Chaleurs Health Foundation for the purposes of recruiting human resources, volunteers and for the purposes of soliciting financial or other contributions;

  • third party service providers and/or partners, including those who provide us with fundraising, database analysis, website, application development, hosting, maintenance and other services. These third parties may have access to or process personal information in connection with the services they provide to us. We limit the information we provide to these service providers to that which is reasonably necessary to enable them to perform their functions, and our contracts with these service providers require them to maintain the confidentiality of this information;

  • government authorities and law enforcement agencies when required to do so by applicable laws. For greater certainty, we may disclose personal information and other information if we are required to do so by law, including tax laws, or if we believe in good faith that such disclosure is necessary to comply with applicable laws, in response to a court order or a government subpoena or search warrant, or otherwise to cooperate with such government authorities and law enforcement agencies;

  • The acquirer, successor or assignee in connection with any merger, acquisition, debt financing, sale of assets or similar transaction, or in the event of an insolvency, bankruptcy or receivership involving the transfer of personal information as a business asset to one or more third parties;

  • We will only use personal information for the purpose of achieving the primary purpose and applicable legitimate purpose for which it was collected, or for purposes compatible with that primary purpose.

 

The organization uses the services of third-party sites, such as Google and Facebook, to promote its content and offers. When you visit our website, these third parties may use cookies, invisible pixels or other similar technologies on your hard drive to collect or receive information about your browsing on the website and elsewhere on the Internet. These technologies allow us to deliver relevant and targeted advertising based on your interests. You can consult the cookies and destroy them if you wish. You therefore have full control over them. How long do we keep personal information?

We will retain personal information only as long as necessary for the purposes set out in this Privacy Policy and to comply with our legal and regulatory obligations.

JeDonneEnLigne data is stored in a MySql database, and Prodon data in a Microsoft SQL Server database. The hosting provider is SOC 2 Type II certified and meets the highest security standards on the market, with 24/7 monitoring and high-performance antivirus software.  No data is transferred outside Quebec.

 

Certain lists, including the personal information of participants in Fondation Santé Baie-des-Chaleurs fund-raising activities, are also stored on the CISSS de la Gaspésie network and on the CISSS de la Gaspésie Cloud, via Sharepoint.

How do we protect personal information?

We follow generally accepted industry standards to protect the information submitted to us, both during transmission and once we receive it. We maintain appropriate physical, technical and administrative safeguards to protect personal information against accidental or unlawful destruction, accidental loss, alteration, unauthorized disclosure or access, misuse or any other unlawful processing of personal information in our possession. We have taken steps to ensure that only those personnel who have access to your personal information have a business need to know or whose job duties reasonably require the knowledge of the information.

 

However, no method of transmission over the Internet or means of electronic storage is 100% secure. We cannot ensure or warrant the security of any information you transmit or provide to us, and you do so at your own risk. Nor can we guarantee that such information will not be accessed, obtained, disclosed, altered or destroyed through breach of our physical, technical or administrative safeguards. If you have reason to believe that personal information has been compromised, please contact us using the contact information provided in the “ How to Contact Us ” section. If a confidentiality incident involving your personal information occurs, we undertake to notify you as soon as possible following our knowledge of the incident. We will take reasonable steps to reduce the risk of harm and prevent future incidents of the same nature from occurring.

In certain circumstances and in accordance with applicable data protection laws, an individual has the following rights:

 

  • Access: the right to ask whether we are processing information and, if so, to request access to the personal information. Subject to applicable law and, where applicable, payment of a monetary sum, the individual may thus receive a copy of the personal information we hold and certain other information about them;

  • Accuracy: We are required to take reasonable steps to ensure that personal information in our possession is accurate, complete, not misleading and up-to-date;

  • Rectification: the right to request that any incomplete or inaccurate personal information we hold be rectified.

  • De-indexing: the right to request that their personal information cease to be disseminated or that any hyperlink attached to their name providing access to information be de-indexed if such dissemination causes them harm or contravenes the law or a court order (right to erasure or to be forgotten)

  • Anonymization: the fact that our organization can, instead of destroying them, anonymize personal information to use them, but only for serious and legitimate purposes (e.g.: retention of information required for possible tax inspection purposes) (It could however be simpler for us to destroy them than to anonymize them).

  • The right to be informed when you are subject to a decision based exclusively on automated processing;

  • The right to be informed when identification, location or profiling technology is used and the means offered to activate these functions.

 

Finally, it is also possible to file a complaint with a data protection supervisory authority, more particularly in the country, province or state in which you normally reside (in Quebec, the Commission d'accès à l'information), in which we are located or in which an alleged infringement of data protection laws has been committed.
